By accessing or using the GC SiteSafe application and its services (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions of Usage ("Terms"). By registering for, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Goddard Consulting LLP.

GC SiteSafe is a web-based platform designed to assist users in managing construction project safety documentation, inspections, permits, inductions, and incident reporting. The Service provides tools for uploading, storing, and organising various types of safety-related information.

3. User Accounts
a. Registration: To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this Section. c. Access Tiers: Access to certain features, including the ability to create new projects or download specific templates, may be restricted based on your account tier (e.g., "Trial" vs. "Full Access"). We reserve the right to modify or introduce new access tiers and their associated restrictions at any time.

4. User Content and Data
a. Ownership: You retain all ownership rights to any data, documents, files, text, images, or other materials that you upload, submit, or store on the Service ("User Content").
b. Licenses: By submitting User Content to the Service, you grant Goddard Consulting LLP a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content solely for the purpose of providing and operating the Service.
c. Backup Responsibility: YOU ARE SOLELY RESPONSIBLE FOR CREATING AND MAINTAINING YOUR OWN BACKUP COPIES OF ALL USER CONTENT, DATA, AND DOCUMENTS UPLOADED TO OR GENERATED WITHIN GC SITESAFE. While we employ reasonable measures to protect data integrity and prevent data loss, we do not guarantee that your User Content will be continuously available or that any lost User Content can be recovered. We shall not be liable for any loss, corruption, or unavailability of your User Content.
d. Accuracy: You are solely responsible for the accuracy, quality, integrity, legality, reliability, and appropriateness of all User Content.

5. Prohibited Uses
You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms, including but not limited to:
a. Uploading or transmitting any User Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, or invasive of another's privacy.
b. Uploading or transmitting any User Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
c. Engaging in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
d. Attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION, SHALL BE LIMITED TO THE AMOUNT YOU PAID, IF ANY, TO [YOUR COMPANY NAME] FOR THE USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Modifications to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
